The whole agreement, in the words it actually works in.

Three screens. No part of this is different from what the rest of the site says, and if you find somewhere it is, the version here is the one that counts.

Who you are dealing with

TheyName is Charlie Kaylor, working alone. There is no team and no account manager, so the person who builds your site is the person who answers your email.

I work from the United Kingdom and most of my clients are in the United States. I am saying so here rather than leaving you to work it out, because it changes one practical thing: I am five hours ahead of the east coast, so an email sent at the end of your day is usually answered before you start the next one.

What you are buying

A subscription. Not a project with an end date. Each month buys the site being built and kept running, the work that gets it found, your Google Business Profile set up and maintained, and the monthly read of whether any of it is working.

The full list of what is included at each price is on the start page, and that list is part of this agreement. If something is not on it, it is not included, and the honest answer to anything else you ask for is a separate quote rather than a yes.

What it costs

Entry is $399 a month. Growth is $599 a month. There is no setup fee and no minimum term.

The first payment is taken on the day you sign up and every month after that on the same date. Payment is handled by Stripe. Your card details go to them and never to me, and you can change or remove the card through the link on any receipt.

A custom build is quoted per job and does not run on these terms. The scope and the price are written down and agreed before anything starts.

The first seven days after it goes live

Nothing goes live until you have approved it. There is no cap on the revisions before that point and no clock running on them.

Once the site is live you have seven days: if it is not what you approved, say so and I refund the month in full. You do not have to give a reason and I will not ask you to sit through a call about it.

The clock starts at go-live rather than at payment, which is why it is seven days rather than fourteen. In practice it usually lands later than the old fourteen did, because it begins when you have the site in front of you rather than while you are waiting for it.

What the seven days covers is the build, because that is what anyone can judge in a week. Whether the engines start naming you is a separate question, measured monthly in the read, and it takes longer than a week to answer honestly either way.

The site comes down when the refund is made, and everything listed under what is yours below stays yours.

Cancelling

Email me and it stops. There is no notice period and no form to find. The subscription ends at the end of the month you have already paid for, and nothing further is taken.

I can end it too, with a month's notice, and the same applies in reverse: what is yours stays yours and the last month is not charged.

What is yours, from the first day

The domain is registered in your name and your email, not mine. So is your Google Business Profile and so is the analytics account. I have access to all three as a collaborator you can remove in a click.

Your words, your photos, your logo and every lead the site has ever taken are yours as well. You can ask for an export at any time, including on the day you leave, and you get it in a format you can open rather than one only I can read.

None of this is ever held back to make leaving harder. It is deliberately the opposite way round from how most of this industry works.

What is rented

The build itself. The design, the code and the hosting run while you subscribe and come down when you stop.

That is the trade for there being no setup fee. The build is paid for out of the monthly rather than up front, so the monthly is what keeps it up. If the site stayed regardless, a single month would buy a site outright, and nobody could make that work.

When it comes down, the domain is yours to point anywhere the same afternoon, and I will help you do it.

Keeping the build as well

If you want to leave and keep the site, the price to buy the build outright is $5,000. It is flat: it does not reduce with the months you have already paid, because the monthly pays for the work rather than towards owning the code.

There is no month at which it reaches nothing. What you pay each month buys that month's work — the site kept running, the profile maintained, the read — and none of it is an instalment towards owning the code. Those are two separate transactions at two separate prices, and this clause is the only place the second one is set.

You get the code, the content and the accounts, built on standard technology any competent developer can pick up. There is no part of it only I can maintain.

What I need from you

A reply. That is genuinely the whole of it. The first look is built from what is already on your current site, so nothing is waiting on you before it exists, but it cannot go live until you have looked at it and told me what is wrong.

If I cannot reach you for thirty days, the work pauses and the subscription keeps running, because the site stays up and the hosting is still being paid for. Tell me you are busy and I will pause the billing instead.

Anything you send me has to be yours to send. If you give me photographs you do not own the rights to, taking them down is the only thing I can do about it.

What I am not promising

I am not promising a position in any search result, a number of leads, or a level of revenue. Nobody can promise those and the ones who do are describing something they do not control.

What I am promising is the work on the list, done, and a monthly measurement honest enough to show you when it is not working. If the numbers go the wrong way you will hear it from me first rather than find it yourself.

The site runs on services I do not own, and occasionally one of them fails. When that happens you get a text from me rather than a customer telling you.

Changes to these terms

If I change anything here, you get an email saying what changed and why, at least thirty days before it applies to you. Carrying on paying after that is what accepts it, and cancelling costs nothing.

The price you signed up at does not go up for as long as you stay subscribed without a break.

The legal part

This agreement is governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over it.

If any single clause here turns out to be unenforceable, the rest of it still stands.

Questions about any of this

Ask before you sign rather than after. A question about a clause is a reasonable thing to send and it will not cost you the offer.
